ICRUNCH LIMITED - TRADING AS CRUNCH
ENGAGEMENT STATEMENT AND AUTHORISATION DOCUMENT

This document is a contract between the following parties:
ICrunch Ltd - Trading as Crunch
and
The Client

This engagement document defines:

  • the services that Crunch will perform
  • the clients responsibilities under our relationship
  • gives us authorisation to act on your behalf.

The Client acknowledges and accepts that a legally binding contract is formed between the parties, and the client agrees to be bound by the following terms and conditions.

  1. The Client authorises Crunch ( ICrunch Ltd Trading as Crunch is herein referred to as Crunch) to act as its Tax Agent including linking to the iCrunch Ltd Tax Agency with the IRD and request information as and when required. Crunch is therefore authorised to sign any taxation return on behalf the client or associated entities.
  2. This document is an authority to any third party to release information about the Client to Crunch if required in order to process the accounts (eg your Bank) which would otherwise be protected from disclosure by the provisions of the Privacy Act 1993.
  3. This contract will continue in effect from year to year. Crunch may amend this contract with new terms and conditions, which will be provided to the in Client in writing before they take effect.
  4. The client hereby instructs Crunch to prepare financial statements and/or taxation returns.
  5. The Client is responsible for proving accurate and complete information necessary to compile such statements thus the responsibility for the accuracy and completeness of the assertions in the Financial Statements remains with the Client.
  6. The Financial Statements will be conspicuously marked as being unaudited.
  7. The Client shall attach Crunch's disclaimer when distributing the Financial Statements to third parties. If the Client distributes the Financial Statements (or other report) to any person without attaching the Crunch statement disclaiming liability, then the Client agrees it will indemnify Crunch against all claims, actions, damages, liabilities, costs and expenses (including but not limited to reasonable legal costs and expenses) incurred by Crunch and arising out of or in connection with any action, claim or proceeding brought by any third party in connection with the services provided by Crunch to the Client.
  8. Crunch will complete your Financial Statements from information provided by the Client in accordance with the Statement of Compilation Engagement Standards issued by the Institute of Chartered Accountants of New Zealand.
  9. Crunch will be responsible for the preparation and lodgment of Income Tax Returns for the Client.
  10. During preparation of the financial statements and taxation returns Crunch will not be specifically investigating non-compliance with laws and regulations - however should anything come to light of this nature during the process, you will bring that to my/our attention.
  11. The responsibility of paying the correct Tax and paying on time rests with the Client, and not with Crunch as the Agent. Any penalties arising from lateness, errors, wrong estimates, or for any other reason, are payable by the Client as the Taxpayer.
  12. The financial reports supplied by Crunch will be for 'Special Purpose' only and are only to be used to determine your taxation status.
  13. We will submit your tax return to the IRD based on the information we have at the time of processing your accounts. The IRD will then assess the return. If there is an adjustment required by the IRD that is due to an error on our part; we will resubmit the return at no cost. If however the adjustment is due to an error with the information supplied to us by the client, the cost of resubmitting the return will be on-charged.
